The Department of State has published a pamphlet educating nonimmigrant visa holders on their rights. The pamphlet covers the visa process, important documents, workplace and employee rights, human trafficking, and how to file a complaint. This is a very useful document, not just for immigrants. He can have both types of permanent residence pending at the same time - marriage-based and employment-based. This is very common. The marriage-based filing will probably be approved sooner than the other, because priority dates are so backlogged now.

Just fyi to be cautious.
There was a CBP Admission Review Squad at Washinton Dulles Airport on 11th evening. They sent all passengers from multiple flights to secondary check where they had to wait for over 4 hours. They were instances were people were not admitted or given just 1 month entry with specific instructions written on I94 that they cannot apply for EOS or AOS. This is for visiting Visa.

your wife's application should be tied to your PD. If you got it in EB1, then she too should be in EB1. The pearson memo will help. Get an infopass and clarify the issue.

My situation is that Lawyer says I-485 appl. was hand delivered to INS at Nebraska on July 2nd morn. They had sent about 300 appls. July 2nd that way to avoid the change of dates fiasco etc.
Now, his office says that INS has not given any receipt for the delivery or acceptance of the hand delivered packages and there is no way to get a receipt etc. until checks are cleared. Since there is no tracking # etc. from fedex we are in the dark about the acceptance situation. According to him none of the packets have been returned either.
Is there anyone else in a similar situation?

Is the postal address same for EAD & AP renewal for e-Filers.
The forms that printed out for EAD & AP renewal for e-Filers shows same address to send the supporting documents.
And only EAD needs the 2 photos right not the AP for e-Filers.

-> I am planning to change job now.
-> Question is; should I file for H1 Xfer or just take my chances with EAD?

Our lawyer had posted our application on July 2nd and we had our fingerprinting scheduled for 21st august which was completed.
I checked my status on the USCIS site for the very first time today. And it says. "On July 30, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case" . Can anyone kindly explain me what this means ( how July 30th and what mail are they talking about ?we never received any! ) ...

I came to US on H4. My H1B got approved when i was in India. But I came through H4 only.
Now i want to change H4 to H1B. If i want to apply for change of status..do i need to go back to india(ot other countries) for stamping? Or can i get H1B staying here?

My parents got their second Re-entry Permit approved (applied through Application I-131) in first week of Jan 2008. This rentry permit is valid for 2 years (i.e. till Jan 2010). They had applied for the second Re-entry Permit on 16th Feb 2007. And after applying it they left 19th Feb 2007.
They are planning to return to US in Jan 2010 before the Re-entry Permit expiration. I read on this and other forums that with Re-entry Permit a US resident can live outside for more than 1 year and less than 2 years.
In my parent's case, when they will return back to US in Jan 2010, they will already have spend 3 years outside US.
I was concerned that the 2 year stay limit will be counted from the day my parents left US or the day when the Re-entry Permit got approved?
Secondly, Is there any limit on number of times a Re-Entry Permit can be applied?
